Order Denying Motion for Reconsideration - Plaintiff Kerel L. Seabrooks has filed a motion to reconsider the Court's December 14, 2018, Order Screening Complaint in part, dkt. #8 . Specifically, Mr. Seabrooks argues that the Court improperly dismissed his excessive force claims against Correctional Officer Stone and the unknown guard based on statute of limitations. Order Screening Complaint, Severing Claims, and Directing Service of Process - The claims remaining in this case are the First Amendment claims for retaliation against Counselor Rader, Lieutenant Kruhl, Case Manager Randall, and Officer Lee. The Court has additionally taken or directed the following actions: the claims against Correctional Officer Stone, Supervisor Miller, Correctional Officer Mawro, and the unknown guard are dismissed; the claims against Captain Gard are severed from the original complaint and a new civil action from the Terre Haute Division shall be opened consistent with the instructions in Section I(D); the clerk is designated pursuant to Fed. R. Civ. P. 4(c)(3) to issue process to defendants Counselor Rader, Lieutenant Kruhl, Case Manager Randall, and Officer Lee consistent with the instructions in Section I(E); the clerk is directed to terminate defendants Correctional Officer Stone, Supervisor Miller, Correctional Officer Mawro, and Captain Gard from the docket; and the clerk is directed to update the docket to reflect the correct spelling of "D.
