November 26, 2018 Opinion or Order Filing 1 Entry Discussing Rule 60(b) Motion and Directing Opening of New Civil Action - The Court denied the petitioner's habeas petition brought pursuant to 28 U.S.C. 2254 and entered final judgment in this action on January 7, 2016. The petitioner appealed, and the Seventh Circuit denied him a certificate of appealability on November 4, 2016. Approximately two years later, the petitioner filed the instant motion seeking relief from judgment pursuant to Rule 60(b). Accordingly, the petitioner's motion must be treated as a new action brought pursuant to 28 U.S.C. 2254 and, dkt. 37, is terminated in this action. The clerk is directed to open a new civil action in the Terre Haute Division. A copy of this Order shall also be docketed in the newly opened action. (See Entry.)
