ORDER SCREENING COMPLAINT, DISMISSING DEFICIENT CLAIMS AND DEFENDANTS, AND DIRECTING ISSUANCE AND SERVICE OF PROCESS - The clerk is directed pursuant to Federal Rule of Civil Procedure 4(c)(3) to issue process to defendant Warden Dick Brown in the manner specified by Rule 4(d). Process shall consist of the complaint, dkt. #1 , applicable forms (Notice of Lawsuit and Request for Waiver of Service of Summons and Waiver of Service of Summons), and this Order. The Court has screened Mr. Swisher's complaint and 1) directed that Mr. Swisher's Eighth and Fourteenth Amendment claims shall proceed against defendant Warden Dick Brown; 2) dismissed all other claims and defendants; 3) directed service of process; and 4) allowed Mr. Swisher through May 23, 2019, in which to file a motion to reconsider or an amended complaint that cures the deficiencies discussed in this Order. The clerk is directed to terminate the Indiana Department of Corrections and Warden Grage from the docket. (See Order.) Copy to Plaintiff via U.S. Mail.
