Order Directing Dismissal of Action - Mr. Chappell was directed to show cause why this action should not be dismissed. Mr. Chappell submitted an additional filing further challenging the conditions of his confinement, but he did not respond to the directions to show why this action should not be dismissed. Accordingly, for the reasons discussed in the Order of January 16, 2020, specifically that Mr. Chappell challenges the conditions of his confinement and not its fact or duration this action must be dismissed. Entry Granting Motion to Proceed in forma pauperis, Dismissing Petition, and Directing Petitioner to Show Cause - Petitioner Bryan Chappells motion to proceed in forma pauperis, dkt. #2 , is granted. For the foregoing reasons, the habeas petition is summarily dismissed. The petitioner shall have through February 17, 2020, in which to show cause why the action should not be dismissed. Failure to do so will result in the dismissal of this action with prejudice without further notice. The clerk shall include a form civil rights complaint with the petitioners copy of this Order.
