Filing 5 Order Directing Dismissal of Action - On December 9, 2019, Plaintiff filed a complaint against the defendants which was assigned case number 2:19-cv-00597- JRS-DLP. On January 13, 2020, the Court dismissed the complaint and gave Mr. Kline through February 10, 2020, in which to amend his complaint. See 2:19-cv- 00597-JRS-DLP at dkt. 8. On February 25, 2020, Mr. Kline filed a complaint against the defendants which initiated this case. Mr. Kline did not label the complaint "Amended Complaint", nor did he include a case number, but the operative facts alleged in this complaint are identical to those in case number 2:19-cv-00597-JRS-DLP. This action is dismissed without prejudice, and the clerk is directed to docket the complaint at dkt. #1 as an amended complaint in case number 2:19-cv-00597-JRS-DLP. Mr. Kline's motion for leave to proceed in forma pauperis, dkt. #2 , is denied as moot.Judgment consistent with this Order shall now issue. Copy to Plaint via US Mail. Signed by Judge James R.
