November 25, 2020 Opinion or Order Filing 3 Order Dismissing Motion to Vacate, Set Aside, or Correct Sentence and Denying Certificate of Appealability - Petitioner Kenneth Shelton seeks relief from his sentence in No. 2:13-cr-00029- JMS-CMM-1. He does so after having previously challenged his sentence pursuant to 28 U.S.C. 2255 in No. 2:16-cv-00250-JMS-MJD. That action was decided on the merits and dismissed with prejudice on May 16, 2017. This action is therefore dismissed for lack of jurisdiction. Judgment consistent with this Order shall now issue and a copy of this Order shall be docketed in No. 2:13-cr-00029-JMS-CMM-1.
