Filing 5 ORDER DENYING MOTION FOR LEAVE TO PROCEED IN FORMA PAUPERIS, DISMISSING COMPLAINT, AND DIRECTING FURTHER PROCEEDINGS - Mr. McCullough's motion for leave to proceed in forma pauperis, dkt. #2 , is denied for the reasons discussed in Part I. His complaint is dismissed for the reasons discussed in Part II. Mr. McCullough shall have through March 3, 2021, to file an amended complaint that resolves the deficiencies discussed in Part II. He shall also have through March 3, 2021, to resolve the filing fee issue as directed in Part I. If Mr. McCullough chooses to file an amended complaint, he must use the form provided by the Court, and he must include the case number associated with this action, no. 2:21-cv-00057-JRS-MJD. It will completely replace the original complaint, and it will be screened pursuant to 1915A, so it must include all defendants, claims, and factual allegations that Mr. McCullough wishes to pursue in this action. If Mr. McCullough fails to comply with these orders in the time provided, the Court will dismiss this action for failure to state a claim upon which relief can be granted without further warning or opportunity to show cause and enter final judgment. The clerk is requested to include a blank civil rights complaint form with Mr. McCullough's copy of this Order. SEE ORDER. Copy sent to Plaintiff via US Mail. Signed by Judge James R.
