Entry Dismissing Motion to Vacate, Set Aside, or Correct Sentence and Denying a Certificate of Appealability - Petitioner Jose Silva-Vasquez pled guilty to conspiracy to distribute drugs and money laundering in United States v. Vasquez-Silva, 2:10-cr-26-JMS-CMM-1. He was sentenced to 300 months' imprisonment, to be followed by ten years of supervised release. Judgment was entered on May 2, 2012. Crim. Dkt. 851 . Now before the Court is his successive motion for relief from that sentence. Petitioner's successive 2255 motion is dismissed for lack of jurisdiction and a Certificate of Appealability shall not issue. Judgment consistent with this Entry shall now issue and a copy of this Entry shall be docketed in 2:10-cr-26-JMS-CMM-1. The motion to vacate, Crim. Dkt. 1127 , shall also be terminated in the underlying criminal action. Copy to Petitioner via US Mail. See Order. Signed by Judge Jane Magnus-Stinson on 7/23/2021.(KAA)
