ORDER DIRECTING PETITIONER TO SHOW CAUSE - Tracey Wheeler's petition for a writ of habeas corpus challenges his sentence calculation based on a dispute about pre-sentence credit. Dkt. #1 . Because it appears from the face of the petition that Mr. Wheeler has not exhausted available state-court remedies, he is ordered to show cause why this action should not be dismissed without prejudice based on failure to exhaust available state-court remedies. Indiana's state judicial process remains available to Mr. Wheeler, and he has not shown it to be ineffective. Mr. Wheeler is therefore ORDERED to show cause why this action should not be dismissed for failure to exhaust available state court remedies. If Mr. Wheeler does not respond to this order by September 22, 2023, this action will be dismissed without further notice or opportunity to show cause. (See Order.) Copy to Petitioner via U.S. Mail.
