February 5, 2024 Opinion or Order Filing 10 ORDER DENYING PLAINTIFF'S MOTION FOR PRELIMINARY INJUNCTION AND EXTENDING DEADLINE TO RESOLVE FILING FEE - the Court DENIES Mr. Halligan's initial motion for preliminary injunction, dkt. [ #3 ], as MOOT because it is superseded by his amended motion at docket #8 . The Court reminds Mr. Halligan, however, that he must first resolve the filing fee for this action as set forth in the Notice of Deficiency issued on January 3, 2024, before the Court can screen his complaint or initiate briefing on his amended motion for preliminary injunction. See dkt. #7 . The Court sua sponte extends Mr. Halligan's deadline to either pay the $405.00 filing fee for this action or to demonstrate that he lacks the financial ability to do so by filing a motion for leave to proceed in forma pauperis. Mr. Halligan shall have through March 1, 2024, to take either of these actions. The failure to do so within this extended time will result in the dismissal of this action without further warning or opportunity to show cause. See Order for additional information.
