ORDER - Plaintiff's motion for Court assistance, Dkt. #7 , is GRANTED to the extent that the Court explains that the Notice, Consent, and Reference of a Civil Action to Magistrate Judge form he received from the Court does not have a judge's name or signature at the bottom because the presiding district judge cannot and will not refer this case to the magistrate judge unless all parties consent to such referral. The Court also explains that, in its November 15, 2024, Order, the Court gave Plaintiff until December 14, 2024, to notify the Court of which claims he wishes to pursue in this case and to pay an initial partial filing fee of $29.33. (Dkt. #9 ). The Court sua sponte extends that deadline up to and including January 2, 2025. The clerk is directed to enclose copies of the following with Plaintiff's copy of this Order: (1) public docket sheet; and (2) November 15, 2024, Order, (Dkt. #9 ). Copy to Plaintiff via US mail. ORDER GRANTING MOTION FOR LEAVE TO PROCEED IN FORMA PAUPERIS, SEVERING UNRELATED CLAIMS, AND DIRECTING FURTHER PROCEEDINGS - The plaintiff's motion to proceed in forma pauperis, dkt. #2 , is granted to the extent that the plaintiff is assessed an initial partial filing fee of Twenty-Nine Dollars and Thirty Three Cents ($29.33). The plaintiff shall have through December 14, 2024, in which to pay this sum to the clerk of the district court. Mr. Thomas will have through December 14, 2024, to notify the Court whether he wishes to pursue (a) his claims arising from Thomas' request for trans-affirming healthcare, or (b) his remaining religious claims, in this case. His notice must also state whether he wishes for the Court to open a new action for the second group of claims. (See Order.) Signed by District Judge Matthew P. Brookman on 11/15/2024.
