November 4, 2024 Opinion or Order Filing 10 Order on In Forma Pauperis Status and Directing Plaintiff to File Complaint - The plaintiff's motion to proceed in forma pauperis, dkt. #8 , is granted. Although the plaintiff is excused from pre-paying the full filing fee, he still must pay the three hundred and fifty dollar ($350.00) filing fee when able. No initial partial filing fee is due at this time. According to Rule 3 of the Federal Rules of Civil Procedure, a civil action is commenced upon the filing of a complaint with the court. If Mr. Davis wishes to file a lawsuit, he must file a complaint. The clerk is directed to include a prisoner complaint form with Mr. Davis' copy of this Order. If no complaint is filed by December 4, 2024, this action may be dismissed without further notice.
