November 15, 2025 Opinion or Order Filing 36 ORDER: The Amended Petition, dkt. 30, alleges that Petitioner's detention is unlawful because he is charged with entering the United States without inspection under 8 U.S.C. 1182(a)(6)(A)(i) and therefore subject to mandatory detention. Dkt. 30 at 2 3. Petitioner alleges that because he previously entered and was residing in the United States, 8 U.S.C. 1225(b)(2)(A) does not apply to him. Instead, he is subject to 8 U.S.C. 1226(a) which allows for release on bond. Id. at 2-3 5. Petitioner further alleges that because DHS chose to place him in "full removal proceedings under 8 U.S.C. 1229a", Respondents cannot reinstate the prior order of removal, so he is not subject to mandatory detention under 8 U.S.C. 1231. Id. at 3 7; id. at 7 28. Petitioner further argues the full removal proceeding initiated in 2023 precludes reinstatement of the prior removal order. Id. at 7 30-32; 41. Because Petitioner raised new arguments in his reply, Respondents may file a supplemental return responding to these new arguments.
