ORDER GRANTING DEFENDANTS' PARTIAL MOTION TO DISMISS - Plaintiff Martin Costanza filed this action alleging that Defendants NiSource, Inc. and Northern Indiana Public Service Company violated federal civil rights law during his employment and constructively discharged him in violation of state law. Defendants have filed a partial motion to dismiss. Dkt. #18 . Defendants' partial motion to dismiss is GRANTED. Dkt. #18 . Mr. Costanza's sexual harassment claim is DISMISSED so Count II will proceed only as a claim of harassment based on national origin. Mr. Costanza SHALL RESPOND by May 4, 2026, stating whether he has an objection to dismissal of NiSource, Inc. and this action proceeding solely against NIPSCO. If he does not respond, NiSource, Inc. will be dismissed. The magistrate judge is asked to hold a telephonic conference with the parties to discuss case status. While in forma pauperis status allows Mr. Costanza to proceed without prepaying the filing fee, he remains liable for the full fees.
