October 20, 2009 Opinion or Order Filing 332 ORDER ON PLAINTIFF'S SUPPLEMENTAL MOTION TO COMPEL - 308 Supplemental Motion to Compel is GRANTED in part and DENIED in part. The Mag. Judge concludes that the documents other than those described below are protected by the attorney-client pr ivilege and that privilege was not waived for the specific reasons described in Grant Thornton's brief at pages 3 and 4. There are certain documents which the Mag. Judge believes must be reviewed in camera before further determination can be ma de as to whether they are protected by attorney-client privilege. Grant Thornton shall provide the following documents for in camera review by the Mag. Susan Hinds shall respond to outstanding interrogatories or request for production by not later than 7/6/09. Ms. H inds and defendant's counsel shall appear, by telephone, before the Magistrate Judge, with their calendars, at the telephonic status conference set for 7/8/09. Ms Hinds will be ordered to provide a date to appear for the taking of her depositio n, which will occur not later than 7/17/09. Ms. Hinds is advised she must respond to discovery and present herself for a deposition. Her failure to comply with these orders may result in this matter being dismissed. 256 Defendant's Motion to Dismiss remains pending before Judge Hamilton. 258 Request for Oral Argument is DENIED.
