FINDINGS OF FACT, CONCLUSIONS OF LAW and DECISION. Judgment shall enter in this case as to Counts Two and Three of the Second Amended Complaint that this court declares that plaintiff, METRO FAMILY, LLC, is entitled to exercise the option contained i n the Option contract signed 11/30/2001, within 18 months commencing 5/1/2009. Plaintiffs' claims under Court Four of the Second Amended Complaint are DISMISSED. The parties have advised the court that they have resolved their dispute under Court One. ENTRY on Cross-Motions to Reconsider. 64 Plaintiffs' Motion to Reconsider Breach of Contract Claim at trial and 86 Defendants' Motion to Reconsider Entry of Summary Judgment are GRANTED. Count One of Plaintiffs' Second Amended Co mplaint is DISMISSED. Count Two of Plaintiffs' Second Amended Complaint remains for trial. The portion of Count Three alleging misrepresentation is DISMISSED. Plaintiffs' claim of Equitable Estoppel remains for trial.
