There was no ineffective assistance of counsel and his sentence was not unconstitutional. Accordingly, Eldridge's Mot ion Under 28 U.S.C. § 2255 to Vacate, Set Aside, or Correct Sentence, (Dkt. 1 ), is DENIED and this action is dismissed with prejudice. Judgment consistent with this Order shall now issue and the Clerk shall docket a copy of this Order in Case No. 4:14-cr-00024-TWP-WGH-1.
