ENTRY GRANTING MOTION TO DISMISS - #5 Motion to Dismiss for Failure to State a Claim is granted. Mr. Ivy is in agreement with dismissal of his claims and he has filed a voluntary Notice of Dismissal, (Dkt. #7 ). Accordingly, the federal claims in this action are dismissed with prejudice. Mr. Ivy's state law claim of negligence is dismissed without prejudice, and he may pursue that claim in state court if he so desires. Final Judgment will issue in a separate order (See Entry).
