Order Directing Plaintiff to Update Address- Plaintiff Garrett Keith filed this lawsuit when he was confined at the Orange County Jail. Dkt. 1. The Court granted his motion to proceed in forma pauperis, dkt. 5, and he was notified of certain duties as a litigant in this Court, dkt. 4. One of those duties is to report any change of address because the Court must be able to locate and communicate with the plaintiff. Dkt. 4. Nevertheless, mail sent to Mr. Keith has been returned undelivered because he is no longer at the Orange County Jail. Dkt. 6, 7. Therefore, Mr. Keith will have through July 8, 2022, to notify the Court in writing of an address at which he can be reached. If he fails to do so, this action will be subject to dismissal as abandoned and for failure to comply with Court orders. Signed by Judge Sarah Evans Barker on 6/14/2022. Copy mailed to plaintiff. ORDER granting #2 Motion for Leave to Proceed in forma pauperis. Although the plaintiff is excused from pre-paying the full filing fee, he still must pay the three hundred and fifty dollar ($350.00) filing fee pursuant to the statutory formula set forth in 28 U.S.C. 1915(b)(2) when able. See 28 U.S.C. 1915(b)(1) ("the prisoner shall be required to pay the full amount of a filing fee."). The assessment of even an initial partial filing fee is waived because the plaintiff has no assets and no means by which to pay a partial filing fee. 28 U.S.C. 1915(b)(4).
