Filing 10 ORDER granting in part #9 Motion: The Court approves all terms of the stipulation, with the exception of paragraph 4. The Clerk is not able to practically remand only parts of an action. Instead, the Clerk is directed to remand the state court action back to the Dearborn Circuit Court, with the understanding that the contested matter arising from the Petition to Assert Interest will be resolved in the instant federal action. This case shall remain open so the contested claim may be resolved in this action at the appropriate time. The parties shall file a status report upon resolution of the state court claims or by February 24, 2023, whichever event occurs first.
