July 21, 2011 Opinion or Order Filing 6 MEMORANDUM OPINION & ORDER: (1) Named Defendant is J. C. Holland, Warden, in his official capacity; (2) Clerk prepare documents necessary for service of process upon Deft; (3) Clerk prepare a "service packet" consisting of the following doc uments for service upon USA: (a) completed summons form; (b) Complaint 2 ; (c) this Order; (d) a completed USM-285 Form; (4) Additionally, the Clerk shall make 3 sets of copies of the above-described documents, each set containing the following: (a) copies of all completed summons forms issued for the Defendant; (b) copies of all completed USM-285 forms; (c) One copy of the Complaint and all attachments; (d) One copy of this Order; (5) Clerk present the service packet to USM Office in Ashland, KY; (6) Service of process upon Deft be conducted by USM Ofc in Ashland, KY by serving a service packet personally to him through arrangement w/Federal Bureau of Prisons; USM Office is responsible for ensuring Deft is successfully served w/process; I n event attempt at service is unsuccessful, USM make further attempts and ascertain such information necessary to ensure successful service; (7) USM complete service by serving copies described in paragraph (4) above by certified or registered mail t o: (a) one set to Civil Process Clerk at US Attorney's Office ED/KY; (b) one set to Office of Attorney General of USA in Washington, D.C.; (c) one set to Office of Federal Bureau of Prisons in Washington, D.C.; (8) The Plaintiff SHALL: (a) Immed iately advise Clerk of any address change; Failure may result in dismissal; (b) Communicate w/court solely thru notices or motions filed w/Clerk's ofc; Court will disregard any correspondence sent directly to Judge's Chambers; (c) In every notice, motion, etc., certify copy to deft or attorney w/date of mailing.
