ORDER: 1) Dudley's #3 Motion for Leave to Proceed in forma pauperis is GRANTED. Section 1915(b)(1) requires inmate pay the $350 filing fee as set forth below; 2) Because of the lack of available assets in Dudley's account, payment of an initial partial filing fee is DEFERRED; 3) The clerk shall open an account in Dudley's name for receipt of the filing fee. The clerk shall complete a Notice of Payment Form (EDKY 525) containing: (1) Dudley's name, (2) his inmate registration number and (3) this case number. The clerk shall serve a copy of this Order and the Notice of Payment Form upon the Warden of the institution Dudley is currently confined; 4) Each month Dudley's custodian shall send the clerk a payment equal to 20% of Dudley's income for the preceding month, but only if that amount exceeds $10 until such time as the entire $350 is paid; 5) Petitioner must immediately advise the Clerk's office of any change in his current mailing address.
