Filing 11 ORDER: 1. Smith's Motion #9 for Leave to Proceed in forma pauperis is GRANTED. 2. Within 28 days Smith must pay $81.56 to Clerk of Court as initial partial filing fee. 3. Clerk of Court shall open account in Smith's name for receipt of filing fee. Clerk shall serve copy of this Order and EDKY 525 upon Jailer/Warden. 4. Each month Smith's custodian shall send the Clerk of Court a pymt in an amount equal to 20% of in income for preceding month out of his inmate trust fund acct but only if amount in acct exceeds $10.00. The custodian shall continue such mthly payments until the entire $350 filing fee is paid 5. Smith must immediately advise Clerk's Office of any change in his current mailing address. Should Smith wish to pursue this federal action, he must either pay the $350.00 filing fee and $50.00 administrative fee or (1) have the Certificate of Inmate Acct certified by prison staff, (2) complete the Affidavit of Assets/In Forma Pauperis App and (3) file both of these docs with the Court. 4.
