January 17, 2020 Opinion or Order Filing 4 ORDER : 10 NOT 1/31/20 Sapp SHALL show cause why his 2254 should not be dismissed as untimely. Sapp shall submit a response limited to the issues of timeliness and equitable tolling by that date. Failure to provide a sufficient basis or otherwise render the petition timely, the Court will likely recommend denial; 2) The clerk shall, by certified mail, serve a copy of the Petition and this Order upon the AG of Ky; 3) Respondent shall file any response to the submission ordered in (1) above, limited to the Commonwealth's posture on petition timeliness and equitable tolling by March 2, 2020; 4) The Commonwealth shall assist the Court in fulfilling its duties under 18 3771(b)(2). To that end, the Court expects the Commonwealth to know the identity of any "victim" and to keep such person reasonably apprised of the developments and public hearings in the case.
