Filing 7 ORDER: 1. The Court DISMISSES without prejudice Lucas's claims against "Nurse Tyler" and the Greenup County Jail; 2. The Court DISMISSES Lucas's claims agianst "Deputy Ryno," "Deputy Nick," and Charles Farley in their official capacities without prejudice; 3. The Court ORDERS the Clerk to prepare "Service Packets" for defendants "Deputy Ryno" "Deputy Nick" and Charles Farley. The Clerk shall deliver the Service Packets to the USMS in Lexington, Kentucky, and note the date of delivery in the docket. Each Service Packet shall include a. a completed summons form b. the Complaint DE #1 c. this Order; and d. a completed USM Form 285; 4. The Court ORDERS the USMS to arrange with the appropriate officials at the Greenup County Detention Center personal service of "Deputy Ryno" "Deputy Nick" and Charles Farley (to the extent they are known and identifiable) with Service Packets at Greenup County Detention Center, 100 Laurel Street, Greenup, Kentucky. Filing 5 ORDER: 1. The Court GRANTS #3 Lucas's Motion for Leave to Proceed in forma pauperis; 2. Because Lucas has been granted pauper status in this proceeding, the Court WAIVES the $52.00 administrative fee. 3. Court ORDERS Clerk of Court to open an acct in Lucas's name for receipt of filing fee. The Clerk shall also complete a form EDKY 525 and send the Notice and copy of this Order to warden of institution 4. Because Lucas lacks the funds to pay it, the Court DEFERS collection of the initial partial filing fee 5. For each month hereafter, if amt in inmate acct exceeds $10 the Court ORDERS custodian to deduct from acct an amt equal to 20% of his income for preceding month and remit sum to Clerk of Court. The custodian shall continue such mthly pymts until the entire $350 filing fee is paid 6. This matter stands submitted for initial screening pursuant to 28 U.S.C. 1915(e)(2), 1915A..
