ORDER: 1. Quarles's claims against Correctional Officer/Deputy Bellamy are DISMISSED without prejudice, and the Clerk's Office is directed to TERMINATE Bellamy as a dft in this action. 2. That said, the Court will allow Quarles to go forward on his claims against the other three defendants. 3. The Deputy Clerk shall prepare three "Service Packets" one for service upon each of the three remaining dfts: Reynolds, Pelfrey, Kirby. Those service packets shall include a. summons b complaint c. this order d. a completed USM-285 4. The Deputy Clerk shall send the Service Packets to the USMS in Lexington, Ky and note the date of delivery in the docket. 5. The USMS shall personally serve the service packets on the dfts at EKCC, and it shall do so through arrangement with appropriate officials at that institution. 6. Within 21 days after being served, the remaining dfts must answer Quarles's complaint 7. Finally, Quarles must immediately advise the Clerk's Office of any change in his mailing address. ORDER: 1. Quarles's motion for leave to proceed in forma pauperis R. #2 is GRANTED and payment of the $52.00 administrative fee is WAIVED. 2. Give then small amt of funds recently deposited in Quarles's inmate trust fund acct, along with the low balance, the Court will not require an initial partial filing fee 3. Clerk of Court shall open an account in Quarles's name for receipt of the filing fee. Clerk complete EDKY 525 form and send copy of this Order and form EDKY525 to Warden of institution where Quarles is confined 4. Quarles's custodian shall send pymt each month in amt equal to 20% of his income for preceding month, but only if amt in acct exceeds $10. Custodian to continue mthly pymts until entire $350 filing fee is paid 5. Matter stands submitted for initial screening. Signed by Judge William O. Bertelsman on 8/11/22.
