ORDER : 1) A clerk shall prepare two Service Packets upon the USA. Each packet shall include: (a) a summons form, (b) #1 Complaint, (c) this Order, and (d) a completed USM Form 285; 2) the Clerk shall send the packets to the USMS in Lexington and note date of delivery in the docket; 3) the USMS shall serve the US by sending on packet by certified or registered mail to the Civil Process Clerk at the US Atty for the EDKY and the other packet by certified mail to the Office of the AG of the US in Washington, DC; 4) W/I 60 days of being served, the US shall answer Gandy's complaint; 5) Gandy need not file any further substantive submissions at this time. ORDER: 1) Gandy's #3 Motion for Leave to Proceed in forma pauperis is GRANTED. The Court WAIVES the $55.00 fee; 2) Gandy must pay the $350 filing fee in a manner set forth below: (a) W/I 30 days Gandy must pay $52.86 to the Clerk, (b) The clerk shall open an account in Gandy's name. The Clerk shall complete an E.D.Ky. 525 Form with Gandy's name, inmate number and case number and shall send to the Warden, (c) Gandy's custodian shall send the Clerk a payment each month equal to 20% OF Gandy's income from the preceding month, only if his account exceeds $10. The custodian shall continue the payments until the $350. filing fee is paid; 3) Gandy must immediately advise the Clerk of any change in his address.
