February 13, 2024 Opinion or Order Filing 10 ORDER: (1) Bailey's claims against the Defendants in their official capacities DE #1 are DISMISSED without prejudice; (2) However, Bailey may proceed with his claims against the Defendants in their individual capacities; (3) The Deputy Clerk shall prepare three Service Packets, one for service upon each of the three named Defendants: Brandon Jones; Nathan Conley; and Wesley Coldiron. Each pkt shall incl. a. a completed summons form b. the complaint at DE#1; c. this Order; and d. a completed USM Form 285; (4) The Deputy Clerk shall send the Service Packets to the USMS in Lexington, Kentucky, and note the date of delivery on the docket; (5) the USMS shall personally serve the three named defendants at the Rowan Co. Detention Center, and it shall do so through arrangement with appropriate officials at that institution; (6) Within 21 days after being served, the Defendants must answer Bailey's complaint. (7) Bailey must immediately advise the Clerk's Office, in writing, of any change in his mailing address. If Bailey fails to do so, the Court will dismiss his case; and (8) Since the next step in the litigation is for the Defendants to answer Bailey's complaint, Bailey does not need to file any additional substantive submissions at this time. February 13, 2024 Opinion or Order Filing 9 ORDER: (1) Bailey's Motion for Leave to Proceed in forma pauperis DE #3 is GRANTED. Because Bailey has been granted pauper status, the Court WAIVES the $55.00 admin fee that would otherwise apply in this case. (2) Pursuant to 28 U.S.C. 1915(b), Bailey must pay the $350.00 filing fee in the manner set forth herein: a. Within 30 days from EOO, Bailey must pay $9.09 to the Clerk of this Court as an initial partial filing fee. See 28 U.S.C. 1915(b)(1)(A). b. The Clerk of Court shall open an account in Bailey's name for receipt of the balance of the filing fee. The Clerk shall complete a Notice of Pymt Form EDKY 525 with Bailey's name, inmate reg. number, and this civil case number. The Clerk shall then send a copy of this Order and the Notice of Payment Form to the Warden of the institution in which Bailey is currently confined. c. Bailey's custodian shall send the Clerk of this Court a payment each month from Bailey's inmate trust fund acct. The payment shall be in an amount equal to 20% of Bailey's income from the preceding month. However, the custodian shall only send a monthly payment if the amount in Bailey's account exceeds $10.00. The custodian shall continue the monthly payments until Bailey's entire $350.00 filing fee is paid. (3) Bailey must immediately advise the Clerk's Office, in writing, of any change in his address. If Bailey fails to do so, the Court may dismiss his case. (4) This matter now stands submitted for initial screening pursuant to 28 U.S.C. 1915A and 1915(e)(2). Signed by Judge David L.
