ORDER : the court DISMISSES with prejudice Warden Green and he is DISMISSED as a party to this action; 2) the Court DIRECTS the Clerk to complete 4 AO Form 398 and 4 AO Form 399 addressed to the Kentucky Dept of Correction on behalf of Keeton, Rye, Elam and Caudill; 3) the clerk shall send by certified mail, 4 copies of the Complaint #1 along with this order and the AO Forms to Office of Legal Services, KDOC, 275 East Main St., P.O. Box 2400, Frankfort, KY 40602-2400; 4) w/i 45 days of receipt of the documents, the Office SHALL complete and file the AO Form 399 for each deft who waives formal service. Each deft shall have 60 days to file an answer or response to the #1 Complaint; 5) for the defts who do not waive service, w/i 45 days the office SHALL file EXPARTE and UNDER SEAL, his or her last known address. ORDER: 1) Winchell's #3 Motion for Leave to Proceed in forma pauperis IS GRANTED; 2) the Court WAIVES the $55 admin fee; 3) the clerk shall open an account in Winchell's name and send him a completed Form EDKY 525, and send a copy of the notice and this order to the Warden; 4) the Court DEFERS collection of the initial partial filing fee; 5) Winchell's custodian shall send payment each month equal to 20% of the preceding month's balance but only if that amount exceeds $10 until the entire $350 is paid.
