Plaintiff's Motion for Summary J udgment 131 filed by Bench Billboard Company is hereby DENIED; 3. The Court DECLARES City of Covington Ordinance 0-2-09 to be constitutional in that it does not, as applied to Bench Billboard, violate either the First or the Fourteenth Amendments t o the United States Constitution; 4. As there remains no justiciable issue before the Court, this matter is hereby DISMISSED and STRICKEN from the docket of Court and 5.
