Filing 101 MEMORANDUM OPINION & ORDER: It is ordered that, 1) 84 Plaintiffs' MOTION to Certify Class is hereby DENIED; 2) Defendant's 98 MOTION for Leave to file Notice of Supplemental Authority is hereby GRANTED, the authority of which was consi dered and analyzed in the Court's decision herein; and 3) Within twenty (20) days from the date of this Order (9/20/2011), Plaitiffs shall file a Status Report indicating how they intend to proceed going forward. More specifically, plaintiffs shall notify the Court whether they intend on pursuing their claims on an individual basis or seek an appeal of the Court's denial of their motion for class certification.
