MEMORANDUM OPINION & ORDER: 1) Clerk of Court shall note Deft's proper name in the case caption of this proceeding; 2) Deft's Motion for Summary Judgment 26 is DENIED; 3) Pltf's Motion for Summary Judgment 28 is GRANTED; 4) Not la ter than 15 days from the date of entry of this Order, the parties shall confer, and submit an agreed amount for the judgment, if agreement can be reached. Deft shall not be deemed to have waived its right to appeal by agreeing to the amount of the jugment. Failing such agreement, the Court will set a hearing to determine the amount of the judgment.
