Filing 149 MEMORANDUM OPINION & ORDER:(1) PNCs Motion for Summary Judgment 104 on Plaintiffs First Amended Complaint is hereby GRANTED;(2) Consortium USAs Motion for Partial Summary Judgment as to Liability 128 on the claims in Plaintiffs First Amended Comp laint is hereby DENIED (3) PNCs Motion for Summary Judgment 133 on its counter-claim against Consortium USA is hereby GRANTED as to liability only;(4) Consortium USAs Motion for Partial Summary Judgment as to Liability 128 on PNCs counter-claim a gainst it is hereby DENIED;(5) The Guarantors Motions for Summary Judgment 126 , 127 on PNCs counter-claim against them are hereby GRANTED; (6) PNCs Motion for Summary Judgment 135 on its counter-claim against the Guarantors is hereby DENIED; (7 ) PNCs Motion to Stay Discovery 105 and Plaintiffs Motion For Hearing and Oral Argument 118 are hereby DENIED as moot; and(8) Not later than July 24, 2013, PNC and Consortium USA shall file a Joint Status Report addressing how the Court should resolve the remaining issue of the amount of damages on PNCs counter-claim against Consortium USA.
