Filing 62 MEMORANDUM OPINION AND ORDER; 1)The 30 Motion to Dismiss filed by defs Commonwealth of Ky Attorney General's Office and Jack Conway in his individual and official capacities is GRANTED; 2)The 36 Motion to Dismiss filed by Defs Ky St ate Police and Captain Greg Crockett, in his individual and official capacities is GRANTED; 2)The 54 Motion for Relief filed by pla Kurt Lowe is DENIED; 4)Lowe's civil RICO claims are DISMISSED against all defs; 5)Lowe 039;s claims under 42USC1983 against Commonwealth of KY Attorney General's Office, KY Attorney General Jack Conway; the KY State Police, KSP Capt. Greg Crockett; U.S. Marshal "Agent Romey", U.S. Marshal "Agent Chris"; KY Stat e Senator John Schickel; Larry Brown of the Florence City Council; and John Schaff, legal counsel for the KY Legislative Ethics Commission, each in his or her individual and official capacities are DISMISSED; 6)Lowe's claims arising under state law against all defs are DISMISSED WITHOUT PREJUDICE; 7)Court will enter an appropriate judgment; 8)Moratorium established by prior 51 Order of the Court w/respect to the filing of new documents in existing cases filed by Lowe is now LIFTED IN PART. Clerk may accept for filing new documents received from Lowe in the follow cases: a: 2:14-cv-92, b: 2:14-cv-141; c: 2:14-cv-168. As noted in a prior order of the Court, the Clerk of the Court must accept and file a notice of a ppeal received from Lowe in a case even if not listed immediately above; 9)The pre-filing authorization required for the filing of any new civil action remains in force; 10)Matter is STRICKEN from the active docket.
