Filing 79 MEMORANDUM OPINION & ORDER: (1) Plaintiff's motion for leave to file an affidavit as a surreply to the motion to strike 74 , is GRANTED;(2) Plaintiff's motion to extend the deadline to file a dispositive motion 67 , is GRANTED ; (3) Defendants' motion to strike plaintiff's cross-motion for summary judgment 64 , is DENIED; (4) Plaintiff's amended complaint 78 , is STRICKEN from the docket; (5) Defendants' joint motion for summary judg ment on all claims 61 , is DENIED IN PART and GRANTED IN PART; (6) Defendant's motion for summary judgment is DENIED as to Counts I, III, and VI against Defendant Aaron Branstutter;(7) All claims against Defendants Michael Crouthers and Amanda Armstrong are DISMISSED WITH PREJUDICE; (8) Counts II, V, and VI against Defendant Aaron Branstutter are DISMISSED WITH PREJUDICE; (9) All claims against Kenton County, Kenton County Fiscal Court, the Kenton County Detention Center, and the individual Defendants in their official capacities are DISMISSED WITH PREJUDICE; (10) Plaintiff's cross-motion for summary judgment on the issues of qualified immunity and the use of excessive force 63 , is G RANTED IN PART and DENIED IN PART; (11) On the issue of liability under Count I against Defendant Aaron Branstutter, insofar as it concerns his conduct in the booking room, summary judgment in favor of plaintiff is GRANTED; (12) A < u>FINAL PRETRIAL CONFERENCE be, and is hereby, SET FOR FRIDAY, JULY 12, AT 1:00 P.M. A copy of the Court's standard final pretrial order shall enter concurrently herewith; (13) A JURY TRIAL on all remaining claims be, and is hereby, SET FOR MONDAY, AUGUST 12, 2019, BEGINNING AT 10:00 A.M.
