Filing 13 VIRTUAL ORDER: granting in part #6 Plaintiff's Motion to Amend Case Caption. Plaintiff points out that the Complaint #1 identified and presented claims against Fedex Ground Package System, Inc., but said corporation was not listed as a defendant in the title of the Complaint nor was a summons issued for it (see #3 ). Plaintiff further points out that Federal Civil Rule 10(a) calls for the title of the complaint in a case to name all parties. In light of this circumstance, along with the recent termination of Defendant Federal Express Corporation pursuant to Plaintiff's Rule 41 compliant Notice of Voluntary Dismissal #7 , the Court concludes the appropriate procedural course to effectuate amendment of the case caption is for Plaintiff to file an Amended Complaint, which Amended Complaint can include Fedex Ground Package System, Inc. in the title and eliminate the references to now voluntarily dismissed Defendant Federal Express Corporation. Plaintiff can also at that time seek issuance of a summons directed to Fedex Ground Package System, Inc. Plaintiff shall file said Amended Complaint by October 26, 2018. Signed by Magistrate Judge Candace J. Smith on 10/16/2018.(ECO)cc: COR |
