SCHEDULING ORDER: 1. The parties have agreed that this is a claim for benefits governed by the Employee Retirement Income Security Act of 1974 ("ERISA") and, therefore, it is exempt from initial disclosures under Fed.R.Civ.P. 26(a)(1)(B)(i). 2. The Defendant will file the Administrative Record on or before Friday, June 18, 2021. In order to avoid the need for redaction as well as to protect Plaintiff's personal medical records, Defendant SHALL file the administrative record under seal. Defendant shall provide Plaintiff with a paper copy of the filing. Plaintiff will file her objections to the Administrative Record, if any, by Monday, July 19, 2021. 3. Motions for leave to conduct discovery shall be filed by Friday, July 30, 2021. 4. On or before Friday, August 13, 2021, the parties shall either: (a) stipulate to the standard of review applicable to this action or (b) submit memoranda of points of authorities regarding the standard of review applicable to this action. The parties' memoranda shall not exceed (5) pages in length. 5. Plaintiff shall file any motion to join parties or amend pleadings by Monday, August 23, 2021. 6. Defendant shall file any motion to join parties or amend pleadings by Monday, August 30, 2021. 7. The parties shall have to and including Friday, December 17, 2021, by which to file all dispositive motions and Daubert motions, with response and reply time as per Local Rule 7.1(c). A courtesy copy of briefs and memoranda in support of motions must be provided to Judge Bertelsman's Chambers within 48 hours of electronic filing; said courtesy copy should be in paper form or emailed (in electronic format using Microsoft Word), to: bertelsman_chambers@kyed.uscourts.gov. 8. Requests to modify any dates or deadlines established by this order shall be submitted upon motion filed prior to expiration of the deadline in question, and upon showing of good cause beyond the control of counsel in the exercise of due diligence.
