ORDER: 1. The claims against the Kenton County Detention Center are DISMISSED with prejudice. 2. The claims against Deputy Sye in his official capacity are DISMISSED with prejudice. 3. A Deputy Clerk shall prepare a "Service Packet" for defendant Deputy Sye. The Service Packet shall include: a. a completed summons form; b. the complaint [R. 1]; c. this Order; and d. a completed USM Form 285. 4. The Deputy Clerk shall deliver the Service Packet to the USMS in Lexington, Kentucky and note the date of delivery in the docket. 5. The USMS shall make arrangements with the appropriate officials at the Kenton County Detention Center to personally serve Deputy Sye with a Service Packet at: Kenton County Detention Center, 3000 Decker Crane Lane, Covington, KY 41017. ORDER: 1. Brown's motion to proceed in forma pauperis #2 is GRANTED. 2. Because Brown has been granted pauper status in this proceeding, the $52.00 administrative fee is waived. District Court Miscellaneous Fee Schedule, 14. Title 28, Section 1915(b)(1), (2) require a prisoner to pay the $350.00 filing fee as set forth below. 3. The Clerk of the Court shall open an account in Brown's name for receipt of the filing fee. The Clerk shall complete a Notice of Payment Form (Form EDKY 525) and shall send the Notice and a copy of this Order to the warden of the institution in which Brown is confined. 4. Because Brown lacks the funds to pay it, collection of the initial partial filing fee is DEFERRED. 5. For each month hereafter, if the amount in Brown's inmate account exceeds $10.00, his custodian shall deduct from Brown's inmate account an amount equal to 20% of his income for the preceding month and remit that sum to the Clerk of the Court. The custodian shall continue such monthly payments until the entire $350.00 filing fee is paid. 6. This matter stands submitted for initial screening pursuant to 28 U.S.C. 1915(e)(2), 1915A.
