MEMORANDUM OPINION & ORDER: 1. Plaintiff Casey's claims against Defendant Quality Correctional Care and his Fourteenth Amendment claims against all defendants are DISMISSED without prejudice and Quality Correctional Care is DISMISSED as a party to this action. 2. Plaintiff Casey's Eighth Amendment claims against Defendants Nurse Jane Doe and Nurse Practitioner Jane Doe remain pending. 3. Plaintiff Casey is advised that if Defendants Nurse Jane Doe and Nurse Practitioner Jane Doe are not named and served within 90 days from the date of this Order, the claims against these defendants will be dismissed pursuant to Rule 4(m) of the Federal Rules of Civil Procedure. 4. If Plaintiff Casey wishes to seek relief from the Court, he must do so by filing a formal motion sent to the Clerk's Office. Any motion Casey files must include a written certification that he has mailed a copy of it to the defendants or their counsel and state the date of mailing. ORDER: 1. Casey's motion to proceed in forma pauperis [Record No. #2 ] is GRANTED. Section 1915(b)(1) requires a prisoner-plaintiff to pay the $350.00 filing fee for a civil action as set forth below: a. The financial documentation filed by Casey indicates that he lacks sufficient income or assets to pay the initial partial filing fee required by 28 U.S.C. 1915(b)(1)(A), thus payment of such fee is DEFERRED. b. The Clerk of the Court is directed to open an account in Casey's name for receipt of the filing fee. The Clerk shall complete a Notice of Payment Form (Form EDKY 525) with: (a) Casey's name; (b) his inmate registration number; and (c) this case number. The Clerk is directed to serve a copy of this Order and the Notice of Payment Form upon the Jailer/Warden of the institution in which Casey is currently confined and upon the Office of the General Counsel for the Department of Corrections in Frankfort, Kentucky. c. Each month Casey's custodian is directed to send the Clerk of the Court a payment in an amount equal to 20% of his income for the preceding month out of his inmate trust fund account, but only if the amount in the account exceeds $10.00. The custodian is directed to continue such monthly payments until the entire $350.00 filing fee is paid. 28 U.S.C. 1915(b)(2). 3. Casey must immediately advise the Clerk's Office of any change in his current mailing address. Failure to do so may result in dismissal of this case. 4. This matter stands submitted for initial screening pursuant to 28 U.S.C. 1915(e)(2), 1915A. Signed by Judge Danny C.
