ORDER: 1) Colemire's allegations against MCDC fail to state a claim upon which relief may be granted and are DISMISSED. 2) Clerk is directed to prepare 8 "Service Packets" for service upon the following defendants: Jailer Lisa Yeary, Chief Deputy Gerald Curtis, Internal Affairs Officer Michael Rigdon, Officer Brandi J. Monroe, Officer Terra Lennex, Officer John Blake Guttridge, Officer Andrew M. Fulton, and Officer Austin Bellew. Each packet shall include: a) completed summons; b) complaint; c) this Order; d) USM 285. 3) Clerk is directed to deliver the Service Packets to the USM in Lexington and note the delivery in the docket. 4) USM is directed to personally serve the 8 defendants at the Mason County Detention Center. 5) Colemire must immediately advise Clerk of any change in address. ORDER: 1) Colemire's motion to proceed in forma pauperis #3 is GRANTED. Colemire is required to pay the $350 filing fee. 2) Within 28 days Colemire must pay $9.91 to the Clerk as an initial partial filing fee. 3) The Clerk is directed to open an account in Colemire's name for the receipt of the filing fee. Clerk is directed to complete a Notice of Payment Form [Form EDKY 525] containing: 1) Colemire's name, 2) inmate number, 3) case number. Clerk to serve a copy of this Order and Payment Form upon the warden which Colemire is confined. 4) Each month, Colemire's custodian is directed to send the Clerk a payment in an amount equal to 20%) of Colemires income for the preceding month out of his inmate trust fund account, but only if the amount in the account exceeds $10.00. The custodian is directed to continue such monthly payments until the entire $350.00 filing fee is paid. 5) Colemire must immediately advise the Clerk of any change to his address. 6) Matter stands submitted for initial screening.
