May 5, 2005 Opinion or Order Filing 1 MEMORANDUM OPINION & ORDER: (1) action is deemed to have been brought by sole pla, Ricky Jones; (2) Teague, Cundiff, Farris & Richards are not joined as plas in this action; (3) Clerk sever pleadings by Teague (wdky nos. 5,6,9 & 10 & edky nos. 2,4,6 & 7); Cundiff (edky no.5); Farris (edky nos. 3 & 7); Richards (wdky no.4) from this case file & shall establish four separate case files (1 for Teague, 1 for Cundiff, 1 for Richards & 1 for Farris), each file consisting ONLY the afore-enumerated indi vidual filings made by the individual potential pla who signed the individual pleading; (4) because Clk severed all pending mtns in this action and will have filed those mtns in other newly opened actions, Clk term all pending mtns in this action; (5 ) Teague, Cundiff, Farris & Richards are ordered to pay $250 filing fee for a civil action in each of their newly established cases; (6) Teague, Cundiff, Farris & Richards granted 10 days from entry of this Order to pay $250 filing fee or s ubmit IFP application; (7) if not previously done, Teague, Cundiff, Farris & Richards afforded 30 days from this Order to submit their IFP application accompanied by Cert Inmate Acct; (8) Plas on NOTICE if they fail to pay $250 or submit IFP the ir complaint will be dismissed; (9) Plas on NOTICE at time they have paid the $250 or have been granted IFP status, then each pla must also have filed case proof that he or she has exhausted all state court remedies or case will be dismissed; (1 0) Clk place copy of this Order in each newly established severed case file for Teague, Cundiff, Farris & Richards; (11) new case files for Teague, Cundiff, Farris & Richards shall be forwarded to Pro Se Office at expiration of 40 days; (12) this action is DISMISSED, sua sponte, and stricken from the Court's docket & judgment shall be entered contemporaneously w/this Order in favor of dft.
