MEMORANDUM OPINION & ORDER: 1. The Defendants' Motion to Dismiss 9 is GRANTED; 2. Lloyds' Petition for Declaratory Judgment is DISMISSED without prejudice; and 3. Because the Court abstains from resolving the coverage issues, and in light of the parties' concessions at the hearing, Lloyds' claim for breach of contract is DENIED as moot.
