ORDER: This matter is before the Court on the Parties' Agreed Order #8 of Partial Dismissal. Accordingly, and the Court being sufficiently advised, it is hereby ORDERED as follows: 1. The following claims made by Plaintiff Larry Cunningham are DISMISSED WITH PREJUDICE: (i) Count VI asserting a whistleblower claim pursuant to KRS Chapter 61 against the individual Defendants in their individual capacities; and (ii) Count VI, to the extent it seeks punitive damages or injunctive relief; 2. Defendant Kyrkanides Motion to Dismiss #5 is DENIED AS MOOT; and 3. Defendants University of Kentucky, Provost David W. Blackwell, Dean Larry Holloway, and General Counsel William E.
