June 8, 2006 Opinion or Order Filing 3 MEMORANDUM OPINION & ORDER: (1) pla's complaint herein is DISMISSED for lack of subject matter jurisdiction & a contemporaneous Judgment will be entered in favor of the named dft; (2) pla's 2 application to Proceed in forma pauperis is DE NIED; (3) pla is PERMANENTLY BARRED AND ENJOINED from filing any pro se civil action in the EDKY unless he shall present the following: (a) a completed complaint form substantially conforming to this Court's complaint form 123; & (b) contemporan eous full payment of the $350.00 filing fee; or, alternatively, if the pla seeks in forma pauperis status, (a) formal complaint stating a federal claim on a complaint form, as described in this Order; (b) a fully completed 4-page financial affid avit form for non-prisoners' use, also described in this Order; & (c) a motion for leave of Court to bring another civil action, said motion setting out his claim(s), the facts from which his claim(s) arose, & the purpose of the desired lawsuit; (4) The Clerk SHALL NOT FILE any new civil action received from Marcus Bond Johnson, if he does not tender therewith a formal complaint & either the full district court filing fee or motions in conformity w/ subsections (b) - (c) in the imediately p receeding paragraph; & the Clerk SHALL RETURN to Marcus Bond Johnson UNFILED all filings received in violation of this Order; (5) Any failure by Marcus Bond Johnson to abide by the directives set forth in this Order may result in additional sanctions.
