Filing 7 MEMORANDUM OPINION & ORDER (1) pla's 1st, 5th & 8th Amendment claims for damages against dfts Ward & Kapusta in their official capacity are DISMISSED WITH PREJUDICE; (2) pla's 1st, 5th & 8th Amendment claims for damages against BOP are DISM ISSED WITH PREJUDICE; (3) pla's 1st Amendment claims asserted on behalf of FMC-Lexington Inmate Cooper against dfts is DISMISSED WITH PREJUDICE; (4) dfts Ward & Kapusta are required to respond to pla's 1st, 5th & 8th Amendment claims assert ed against them in their individual capacities; (5) BOP is required to respond to pla's various demands for injunctive relief; (6) clerk is directed to issue summons for Ward, individually, Kapusta, individually & BOP; (7) clerk shall serve a co py of this Memo on Atty Gen of US & USA & note service; (8) clerk's office shall prepare copies of complaint, this Memo & USM Form 285 - (a) if insufficient info exists to complete summons or USM 285 re dft, clerk shall make an entry in the dock et stating why the clerk cannot fill out necessary documents; (b) clerk shall forward docs to USM; (c) clerk shall make notation of delivery of docs to USM; (d) USM shall serve docs; (e) USM shall make a return report w/in 40 days; (9) pla shall keep court informed of current address; (10) further pleadings filed by pla shall be served upon dfts or their counsel w/the original to the court.
