March 27, 2009 Opinion or Order Filing 7 MEMORANDUM OPINION & ORDER: IT IS ORDERED THAT: (1) Pla's MOTION for Temporary Restraining Order 4 is DENIED without prejudice. (2) Clerk shall prepare documents for service of process upon : USA and FMC-Lexington Utilization Committee. (3) Fo r each dft, Clerk shall prepare "Service Packet" consisting of: a. summons; b. Complaint and construed Amendment w/all attachments [2,4]; c. payment order granting ifp status; d. this Order; e. completed USM Form 285. (4)Service of process shall be as follows: a. Service by certified or registered mail to civil process clerk at US Attorney, Office of Attorney General, central office of BOP in Washington, D.C. b. Service upon FMC-Lexington Utilization Committed by certified or registere d mail to civil process clerk at US Attorney, Office of Attorney General, central office of BOP in Washington, D.C.(5) Lexington Clerk shall hand-deliver Service Packet for each defendant to USM and obtain delivery receipt which shall be entered into record; (6) USM shall serve Service Packet; (7) W/in 40 days of entry of this Order, USM shall send Service Report to Clerk's Office, Clerk shall file in record; (8) Pla shall advise Clerk of any change in current mailing address. FAILURE TO D O SO MAY RESULT IN DISMISSAL OF CASE; (9)Pla must communicate with Court SOLELY through notices or motions filed with Lexington's Clerk. COURT WILL DISREGARD CORRESPONDENCE SENT DIRECTLY TO JUDGE'S CHAMBERS. (10) with every notice or motion filed pla MUST mail a copy to each dft and include certificate of service.
