Filing 30 MEMORANDUM OPINION AND ORDER: (1) Dfts' 12 Motion to Dismiss for Failure to State a Claim or, in the Alternative, Motion for Summary Judgment is GRANTED, in part, with respect to the following claims and parties: (a) Counts I, II, III and IV as they pertain to Dft LFUCG and Dft R. Kornrupmf, in his official capacity; (b) All claims brought under the Fifth or Fourteenth Amendment against Dft Kornrumpf, in his individual capacity, in Counts I, II, III, and IV; (c) Count V, in its entirety ; (d) Count VI, in its entirety; (e) Count VII, in its entirety; (f) Count VIII, in its entirety; (g) Count IX, in its entirety; (h) Count X, in its entirety; (i) Count XI, in its entirety; (j) Count XII, in its entirety; and (k) Count XIII, in its e ntirety. (2) Dft's 12 Motion to Dismiss is DENIED with respect to the remaining claims. (3) All claims against Dft LFUCG having been resolved, it is DISMISSED as a party to this action.
