MEMORANDUM OPINION AND ORDER: (1) Dft Belcher's 4 Motion to Dismiss is DENIED. (2) Plas' 5 Motion to Compel Arbitration and Enjoin Dft is GRANTED. (3) Dft shall prosecute all of his claims arising out of his residency at Stanton Nursi ng and Rehabilitation Center in accordance with the terms of the arbitration agreement that he signed. (4) Belcher is ENJOINED from pursing the pending state court action against Pla before the Powell Circuit Court. (5) This matter is STRICKEN FROM THE ACTIVE DOCKET, and following the conclusion of arbitration proceedings, either party may petition the Court to reopen this matter to take appropriate action as necessary.
