March 30, 2017	Filing 1 MEMORANDUM OPINION AND ORDER: (1) US Magistrate Judge's Recommended Disposition is ADOPTED and INCORPORATED by reference. (2) Campbell's Motion to Vacate (2255) is GRANTED to the extent that he seeks re-sentencing. The motion is DENIED in all other respects. (3) Campbell's Motion requesting consideration of certain evidence in the re-sentencing hearing is DENIED, without prejudice. Any evidence appropriate for consideration may be submitted upon appointment of counsel. (4) USP is directed to prepare an addendum to Campbell's Presentence Report which includes a recalculation of the guidelines range consistent with the Memorandum Opinion and Order. (5) RE-SENTENCING is scheduled for 5/26/2017 at 1:00 PM in LEXIN GTON before Judge Danny C. Reeves. (6) Having previously determined that Campbell qualifies for court-appointed counsel under the provisions of the CJA, Clerk is directed to select new counsel by random draw to represent Campbell for the purposes of re-sentencing. Notification of this appointment shall be provided forthwith by the Clerk. (7) USM shall transport Dft (incarcerated at FCI, Welch, WV) to Lexington to attend his re-sentencing hearing on 5/26/2017. Campbell should be returned to the district at least one week prior to the re-sentencing hearing for the purpose of meeting and conferring with counsel in preparation for the sentencing hearing.
