October 1, 2018 Opinion or Order Filing 10 SCHEDULING ORDER: 1. The following deadlines and conditions shall be observed in this action: (1) Initial disclosures shall be completed by 10/29/2018. These disclosures need not to be filed in the record. (b) Parties shall complete all fact and expert discovery by 5/31/2019. (c) Supplementation shall be due within 30 days of the discovery of new information. (d) Any motion to join additional parties or amended pleadings due by 5/1/2019 (e) Plaintiff's expert witness shall be disclosed NLT 2/15/2019. Defendant's expert witness shall be disclosed NLT 4/15/2019. (f) All dispositive Motions due by 6/15/2019. 2. Parties shall observe the following directives regarding discovery materials in this case: (a) Initial Disclosures, Interrogatories, and Answers or other responses thereto shall not be filed in the record. (b) Portions of discovery cited in at motion or which may be used at trial shall be filed in the record. 3. Each party may take a maximum of 10 depositions. 4. Parties may serve a maximum of 25 interrogatories. 5. Parties may serve a maximum of 50 request for admission. 6. FINAL PRETRIAL CONFERENCE set for 10/22/2019 at 10:00 AM in LEXINGTON before Judge Claria Horn Boom. 7. Pretrial Filings due NLT21 days before pretrial conference 8. Written objections due NLT 14 days before the pretrial conference. 9. At pretrial conference, counsel shall be prepared to: (a) Discuss and stipulate admissibility; (b) disclose any demonstrative exhibits for use at trial; (c) Premark and label a trial exhibits. 10. NLT 7 working days prior to trial counsel shall submit exhibits to chambers. 11. JURY TRIAL set for 11/19/2019 at 09:30 AM in LEXINGTON before Judge Claria Horn Boom, with counsel to be present at 9:00. Trial is expected to last 4 days. 12. The Court refers this case to Judge Hanly A. Ingram for all Non-dispositive pretrial motion. 13. Discovery disputes shall be resolved in the following manner: (a) Parties shall first confer to resolve dispute. (b) Then parties shall request a telephonic conference with Magistrate Judge. (c) If dispute continues, parties may file appropriate written motion (d) Party may proceed as appropriate under Rule 72; (e) The Court expects parties to raise and address disputes in a manner that avoids disruption of the schedule. 14.
